Terms of Service
Effective upon account creation, purchase, or booking of a scan with DexaCore.
1. Acceptance of Terms
By creating an account, purchasing a package or membership, or booking a scan with DexaCore ("we," "us," or "our"), you agree to be bound by these Terms of Service as well as the Client Intake and Consent to which this is attached. If you do not agree to these terms, please do not use our services.
2. Not Medical Advice
- DexaCore is a wellness and fitness tracking service, not a medical provider.
- Our DEXA scans and reports are for informational purposes only (body composition, fat percentage, lean mass tracking).
- We do not diagnose, treat, or cure any disease or medical condition.
- DexaCore staff are technicians, not doctors. Always consult a qualified healthcare provider regarding any health concerns or before starting a new fitness or nutrition program based on our data.
3. User Accounts & Security
- Account Creation: To access our services, you must create an account. You agree to provide accurate, current, and complete information.
- Credential Security: You are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activities that occur under your account.
4. Scan Packs & Credits
DexaCore offers pre-paid scan packs. A purchase adds credits to your account which can be used to book scans.
- No Expiration: Scan pack credits never expire and may be shared with friends and family.
- No Cash Refunds: Unused credits cannot be redeemed for cash, except where required by law.
5. Memberships
DexaCore memberships provide a recurring scan credit each billing cycle at a discounted rate.
- Cancellation: Memberships may be canceled at any time. Any remaining credits stay in your account after cancellation and follow the rollover policy.
- Non-Transferable Credits: Membership scan credits are personal to the account holder and may not be transferred or shared.
Rollover Policy:
- Flexible by design. Unused scans don’t just disappear.
- One Unused Scan Rolls Over: One unused scan may roll over to the next billing cycle. Example: if you miss your monthly scan, you get 1 extra scan the following month.
- Rollover Cap: Members may not accumulate more than 1 rollover scan at a time. If a member already has a rollover scan, additional unused scans will expire.
- 90-Day Expiration: Rollover scans must be used within 90 days of your original billing date.
- Additional Scans: Need more scans? Active members may purchase additional scans at the discounted member rate.
6. Cancellations, Rescheduling & No-Shows
We respect your time and ours. Appointments can be rescheduled or canceled up to 24 hours in advance without penalty. Late cancellations or no-shows will forfeit the scan credit. Arriving more than 10 minutes late may result in a shortened appointment or forfeited credit at our discretion.
- Cancellation Window: You may cancel or reschedule an appointment up to 24 hours before the scheduled start time without penalty. Your credit will be returned to your account for future use.
- Late Cancellations: If you cancel within 24 hours of your appointment, you forfeit the credit used to book that slot.
- No-Shows: If you do not arrive for your scheduled appointment, the credit is forfeited.
- Late Arrival: If you arrive more than 10 minutes late, we may not be able to accommodate you, and it may be treated as a No-Show at our discretion.
7. Waivers & Preparation
- Mandatory Waiver: You must sign our Liability Waiver and Safety Consent form prior to your first scan. You cannot be scanned without a valid signature on file.
- Preparation: It is your responsibility to follow pre-scan instructions (e.g., proper clothing, hydration, metal removal). Failure to prepare may result in the inability to perform the scan and forfeiture of the appointment slot.
8. Privacy & Data
- Data Collection: When you use our services, we collect personal information including your name, contact information, date of birth, and body composition scan data. This information is used to operate our services, deliver your results, and communicate with you about your account.
- Scan Data: Your body composition data is stored securely and is accessible only to you and authorized DexaCore staff. We do not sell your personal data to third parties. We may share data with service providers who assist in operating our platform, subject to confidentiality obligations.
- Data Retention: We retain your account and scan data for as long as your account is active or as needed to provide services. You may request deletion of your account and associated data by contacting us at info@dexacore.com.
9. Limitation of Liability
- To the fullest extent permitted by applicable law, DexaCore, its owner, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, including but not limited to reliance on scan results, decisions made based on body composition data, or interruption of service.
- In no event shall DexaCore's total liability to you for all claims arising out of or related to these Terms or your use of our services exceed the total amount paid by you to DexaCore in the twelve (12) months preceding the claim.
- Some jurisdictions do not allow the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above limitations may not apply.
10. Governing Law & Disputes
- Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
- Jurisdiction: Any dispute arising from or relating to these Terms or your use of our services shall be subject to the exclusive jurisdiction of the state and federal courts located in San Diego County, California. You consent to personal jurisdiction in those courts.
- Informal Resolution: Before filing any formal claim, you agree to contact us at info@dexacore.com and attempt to resolve the dispute informally. We will make a good faith effort to resolve the matter within 30 days of receiving written notice.
11. Changes to These Terms
DexaCore reserves the right to update or modify these Terms at any time. When we make changes, we will update the effective date at the top of this document and notify you by email or through the app. Your continued use of our services after any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using our services.
